and my boss is horrible, he actually puts in our tips as we make more than we do? can he do this he said if he doesnt we will owe the irs? my question is their is no set tips, so one week we can make more than the next, also we run out of food all the time, and yesturday we were swarn to secracy with spray painting the ceiling with white paint due to mold spots, instead of really fixing it, we also use cofee filters in our roll baskets, instead of napkins because they are cheaper? and my favorite part we were all in trouble yesturday because a table wasnt waited on in less than 1 minute of them sitting, we were all brought in the cooler and were gaven the best *** chewing of our lives, swore at and threatened? this is redick, is their someone i can call or write?

He cant change your tips!!!! Thats against the law! Sounds like fraud and harassment. If you can prove it, report him to the IRS!!

No, I'm pretty sure it's illegal. If anything you will owe the IRS more if he is claiming you are making more than you are. Also, in Maine anyways, there is a minimum wage for waitresses that is lower than regular workers due to tips. And if you don't reach the minimum wage the employer is supposed to make up the difference. This may be what he is trying to avoid--paying you to make up for the lack of tips.
I would contact the local labor organizations and check with them--or the state. Good luck.

You need to find out who his boss is and turn him in on a corporate level. Taking your tips IS STEALING!!!!! And the IRS is your problem and non of his business. The mold on the ceiling can be reported to the health department. But the coffee filters are not a big deal. And last cussing and threatening are not acceptable way of dealing with employees. You can't do that and he should be turned in for that also. You need to do something about this jerk, turn him in.... you shouldn't get fired for it either.

Claiming more tips than you got is definately illegal, I would definately check into the irs and do call The Network, they will be more than happy to help you, especially if you tell them every thing you just posted. The Health Department would be another place to contact about the spray paint and the coffee filters.

The health department needs to know about the mold. Some molds are very toxic. And he can't do that with your tips. If he has a corporate supervisor, start there, if not go to the local unemployment office - they will point you in the right direction.

This is an example of why I very rarely dine out. Nasty. I would quit your job, then talk to the authorities...bring any evidence you can provide down to the police station. Make sure that you are covered though, as your boss may sue you for slander if you are not careful.

You may end up paying additional taxes on the overstated tips. THat is definitely illegal and you need to get proof and do something about it. I feel your boss may be skimming cash and using you as a coverup. If he is doing this on credit cards, it would constitute credit card fraud and you as the server would be liable. This is a bad situation, and you need to expose it.

Depending on what state ur in, I'm quite sure u can contact ur local health department & tell them what u know.
