I mean, if a husband forces himself upon his wife when she does not want sex, is that considered a "rape" by the husband of the wife, and can criminal charges be filed?

If a wife doesn't want it and the husband "forces" sex on her hell yeah its rape. unfortunately marital rape is harder to prove in court. if you do not display signs of struggle-- bruises, scratches then its harder to prove and your best bet is just to get away from the man. Either way I would pursue charges if this makes you uncomfortable and is a common occurance. He has a hand tell him to use it...

Well it's definitely rape anywhere in the USA! Sounds like time to get out of that relationship, whether you choose to file criminal charges or not.

As for the people who thought this applies anywhere in the world, they must be fairly naive. There are many, many countries where it's considered a man's right, women have no say in the matter and could be punished just for complaining or making accusations. Just look at the current mess in Pakistan, where political leaders are threatening to defeat any change to the rape laws (which currrently require 4 male witnesses to prove it was rape)

According to Illinois State Statute, yes there is such a thing as Maritial rape. It is not as common as other "rapes" however it is a serious thing. If you feel that your husband took complete advantage of you but overpowering you and committing the act, I would say contact the police. This is a very difficult subject, because you are married to him and have to press charges on him.

Yes it is considered rape, and with all sex offences, it is not up to you to prove it, it is up to him to disprove, be aware that if you decided to press charges,(which is your decision) he will more then likely be convicted, serve time, and register as a sex offender for the rest of his life. Since you are the victime you will be allowed no contact with him upon his release from prison.
however everyone must be resposible for their actions.

I am pretty sure that that is rape no matter what state you are in. You can easily be rapped by a spouse. Is all you have to say is no. If he continued and you didn't want to he committed rape even though he is your husband.

In Illinois yes it can be

It is harder to prove and the DA may not decide to follow up with the case but it is against the law

If you think that nothing will come out of the matter since it's harder to prove marital rape I suggest you get out of that relationship especially if this is a constant occurrence and you feel threatened!!!

I don't know about Illinois, but if it happens/happened, it's time to get out whether it's covered in Illinois or not.

If your husband has a good lawyer you don't have a chance of winning the case.
