Under UK unless someone has parental rights then they do not have rights of access, usually parental rights are limited to those persons found on the birth certificate, i.e. mum and dad!

In exceptional circumstances the courts will allow access to grandparents, but this has to be shown to be in the best interests of the children, and their parent(s) views are taken into account. If the children are over 10 then the courts do consider the child's views but vary the weight attached to this due to coercion by parents etc!

So generally the answer is NO grandparents have no rights whatsoever, but the courts can grant such rights! Be warned this is not easy, although someone above says it is as a Lawyer I must warn you this is not cheap and in 90% of cases leads to failure!

Age Concern are fighting to get Grandparents more rights like the right to see grandchildren when their childrens relationship breaks down, last week or this week is National Grandparents Day

At present there is no automatic right unfortunatly, but if you go to court you would more than likely get access, unfortunatly again it takes a while sometimes to get to court [ up to 4 months ] I have not seen my sons son since xmas. My son doesn't bother with him and his mother is in prison, her mother and aunty look after the child and always made it awqward for us to see him and it was a rollercoaster of emotions and I would get so upset so we decided to take them to court, but we couldn't afford a solicitor, our income was considered too high for legal aid also so we decided to represent ourselves, but then my brother died without warning and I was so devestated I could hardly function and now its too much emotionally for us to go through. We send him regular gifts and cards and I write him letters for when he is older. He is 2 and a half now, I miss him so much. Apparently there will be a law passed soon that gives grandparents automatic rights to their grandchildren. Im lucky as I have 2 other grandsons whom I also love very much and see quite often so that is some kind of blessing, but not a day passes when I don't think of my grandson I don't see.

Sorry to say but not really, you can get it though the courts though, in other countries such as usa its much better for grandparents.

Yes they do have a right to see their grandchildren. but i don't believe they should argue over seeing them. Its not the law, so they can't legally fight for their right to see them.
