I guess the "form" is the essence. E.g., the poses strike by the model and the lighting and focus used.
When viewed by the audience, it causes one to marvel at the beauty of human forms like Greek statues or think deeper, thinking what the artists is trying to relate.
However, if the 1st thing tat the audience can think about is SEX, then its defintely pornography and distastefully done (in art sense)
I don't think painting, photography or sculpture has any effect on its effect on obscene as they are in essence only the form of media used to communicate the "expression". If it does, maybe, its due to sterotyping of older form of delievery media as comptemporary and not the method (painting, sculpture, ...) or tools (water colour or colour pencils, ...) has an ability to cause obscenity.

All photography is inherently pornographic. It's implicit in the idea of "taking" a picture -- the exploitation and appropriation of one's subject. The reaction of the viewer is almost inevitably first to the subject matter and second to the photograph itself.
The exception would be abstract photography, or photography that signifies no connection to the real world but only to the process of photography itself. Everything else is automatically pornographic in some degree.

there will never be a clear definition, because no one is the ultimate say in what art is.
The closest answer i could give is it is art if the intention is to see the beauty in, or incite some kind of emotional reaction.
If the intention is to sell is so that someone can get some kind of sexual pleasure out of it, its pornography.
I have seen some very distasteful paintings, but i couldn't very well call them pornography just because i didnt like them.

capture the finest moments of life and term it art in photography. art in photography needs pain-taking , restless journey through the mind in selecting the desired subject and turning it out into a wonderful still life. memories are cherished when you see it again and again. creative sense in photography makes it art. pornography also has in it a creative sense of art. if you turn your eyes away from this nature you miss all the wonders of creative art in photography. this is a subject very deep in creativity to be studied. - malini(chittany1@yahoo.com)

Um. To tell you the truth...I studied art, and photographs of nude people IS pornography. Being naked in a PAINTING, SCULPTURE, or DRAWING, is art. Sorry if this disappoints you.

i think it's all in the pose and lighting and what the focus is being put on. if it is on form.. it is typically tasteful... if its focused on body parts then it tends to be more porographic
