my ex-step daughters are going to be 16 in Jan. they want want to get away from their dad, whom they live with, and he is also getting back together with their "real mom" but she hasn't been in their life sense Iv'e been around, which has been sense they were 1 yrs. old. they really have a bad living situation and all they want is to live with me.

HOW DO I GO ABOUT DOING THIS, OR WHAT CAN I DO?????

You have to contact a lawyer!!! Ok can you prove they are unfit parents. if so you might have a case. I know were you and them are comming form. Talk to there parents. see if they are willing to hand over coustady! If not then that is were it gets messy. you could have a chance but the judge is going to think it is going to cause more harm then good. He or she could see it that they kids now have both parents. which is good only if the kids want that!!!

The kids seem old enought to decide were they want to live but right now the parents are in control of them!!!

I wish I could help more, but you need to talk to a lawyer about this.

I do commend you on your efforts to give your step daughters what they want. I bet there are meny step childern that wold love to have you as there parent.

If it comes down to a court battle, a judge will take into consideration the girl's wishes. They are 16 after all, and in some states that is considered old enough to make some adult decisions (as in most states allow you to drive at 16).

If the girls are really serious, let them give depositions to the court, requesting that they be allowed to stay with you.

Another alternative, would be for them to "divorce" their parents. It is not a new idea, and in fact, a movie has been made from a famous case involving just this.

Whatever happens, remember that the results are permanent. The girls could forever alienate their biological mother. But since she hasn't been around for 15 years I don't see that being a problem.

But why would your ex want to go back to the woman he left behind when he met you? Something seems really weird about that.

sucks.
your allegation that he's unfit will not have much credibility because you will be seeking custody... and that's what people do in custody disputes.
those girls are old enough to tell a judge who they want to live with, but court battles take so long you better get started or they will be 18 before you get them.
worst case scenario:
your allegation of him being an unfit parent backfires and those girls end up in the custody of child protective services.
you should fight for them without bashing the other parents.

You can see if the parents will agree to this. If not, you can file for custody of them. The problem with this is that you would have to prove the father unfit in some way. You would have to prove to the court why their situation is bad.

Been there, my wife a parental grandmother and myself (maternal grandfather) wanted custody of are grand children, because there mother (daughter in law) was on drugs and did not want the kids any way. There father (son in law) gone. we paid a good attorney, went to court, judge says good for us, but if good old mom decides she wants them back she gets them. Now I am in Texas laws are different in different states. do not spend lots of money on attorneys (like I did) find out from family services its free. good luck

It's called in the childs best interest, step parents have rights, take it to court, you have a good shot, although it may cost you some $$$$

The kids are old enough to decide who they want 2 live with so if they choose 2 be with U they can't do nothing.A lawyer will tell you the same thing.Good Luck

first try talking to the father and if that does not work get the best lawyer that you can find
