glass have an explossive behaivior i mean when it breaks it becomes in small peices all over the place
glass never been blast resistant but its made in a way to prevent that behaivior its called safty glass its a doubled glass with a plastic sheet between
the thiker the better used in cars for VIPs

I would try a cheaper route first - call the local heath department - they can test the air I think starting at 7 am is reasonable for construction unless there is a local ordinance restricting it you really need to do some due diligence before suing
