No, it is not true....yet. The measure, SB1613, was introduced by Sen. Joe Simitian, D-Palo Alto. The bill requires drivers to use hands-free devices, such as speaker phones and ear buds. The bill will go back to the Senate for final consideration, then to Gov. Arnold Schwarzenegger, who has signaled that he favors such a bill. The measure, If adopted, would take effect July 1, 2008, and authorize police to cite violators with a $20 ticket for the first offense and $50 for each offense thereafter.

I regularly drive from the Mojave Desert of Southern California to Los Angeles and it is still legal to drive while talking on a cellphone. There must be about 2 billion drivers in California and about 3/4 of them have a cell pressed to an ear through grid-lock traffic or speeding down the open freeway. In fact, I'm surprised when I see someone like me driving without one and no stereo or radio with those mega-bass speakers and just paying attention. I don't think they'll pass it in California because it would over-flood the traffic court systems.

I dont know if it officailly has been passed but I heard a while back that they can pull you over if they feel you are being distracted by anything such as a cell phone putting on makeup even eating. I grew up in California but I am in NY now I know its illegal to drive on the base with it but I dont know about the state law on that. I refuse to where that earpeice thing so thank god my cell has speaker phone or I'd never get to where I have to go cuz you have to pull over if you are using it!

If you put your cell phone into a large Sea Shell, like a Conch maybe...then the police will think you are just listening to the sea which is not illegal yet!
