I am looking into the same thing. My son is 4 and he has never seen his father. I am married to a wonderful man, who is the only father that my son has ever known ( calls him daddy, and my husband calls him his son ) .. and we want to have my ex's parental rights terminated, and have my husband adopt him.

If there has been 1 full year with NO contact what so ever.. then there is a case for abandonment. If there are no visits, no calls, no cards, no presents for birthdays and christmases.. that's a case for abandonment, and rights can be terminated.

The problem that I'm having is that my son's grandparents ( ex's parents) buy him things for x-mas and birthdays, and when he goes to their house ( because they love and care about him ) they call their son and tell him that he HAS to come and see his kid. ( although my son thinks he's an uncle )

I'm working around this.. my son hasn't been there since Easter. They have not called or sent anything, so it's been 5 months without contact.. but his birthday is just around the corner and I don't know if they're going to call and ask for him or not.. If they do.. and I say no, then it's my fault, and my time starts all over again.

not sure if my husband and I were able to we would have his ex's rights terminated. She hasn't let him see his daughters in 2 years and we live like 20 mins. away from her b/c she hates me. He pays $700 dollars a month in child support yet ever time he has tried to get visitation the state of Florida gives him the run around. And she has willing admitted she doesn't give a crap about there littlest daughter they are 4 and 5 now she wanted a boy with her and well it came out a girl they were off and on again when she was conceived and Savannah was such a daughters girl it drove her nuts. But for some reason the state seems to think she is mother of the year. I hope you have better luck then we have.

I did.....it was pretty easy actually. The thing is, they generally wont terminate a parents rights unless there is someone there to adopt (i'm sure there are exceptions, like abusive parents, etc.)

In my case, the bio-father had abandoned the kids. I had been remarried and the bio-father didnt want anything to do with the kids, so I just emailed him the paperwork and he signed it.
