There is nothing in the FMLA that prohibits physicians from charging to fill out FMLA paperwork.

My doctor charged me $10 to fill out my FMLA papers, a different doc chared me $50 to fill out disability papers. Doesn't seem fair, especially knowing you're going to be on fixed income of less than you're normally paid, once the application is approved.

I had to pay my regular co-pay to see my doctor to fill out FMLA paperwork. However, when I called to set up the appointment, I made it clear that I was coming in so that she could fill out paperwork for me. I don't know what she would have done if I had just faxed over the papers.

Of course they can. Filling out paperwork is a time consuming task that could be spend with patients. Mine charged me, and I had no problem with it.
