No it is a cake with all the definitions here is the definition of cake

-1 a : a breadlike food made from a dough or batter that is usually fried or baked in small flat shapes and is often unleavened b : a sweet baked food made from a dough or thick batter usually containing flour and sugar and often shortening, eggs, and a raising agent (as baking powder) c : a flattened usually round mass of food that is baked or fried
2 a : a block of compacted or congealed matter

Here is the definition of pie:
-A baked food composed of a pastry shell filled with fruit, meat, cheese, or other ingredients, and usually covered with a pastry crust.
A layer cake having cream, custard, or jelly filling.

Although very closely related still fits into the cake category by the margin of it is ,not a custard filling but made with alternate creams that which pushes it over the edge
so it is a cake with out any shame...

Well, I thought this was interesting, so I looked up the words "pie" and "cake." Pie is a baked pastry shell filled with fruit, meat, etc., and often covered with a crust. Cake is a sweet food made from baked batter or dough. I think there is something called a "cheese pie" where the cheese cake batter is poured into a shell. Hmmm...though, come to think of it, the graham cracker crust is actually a shell. I guess you're right. Interesting!
