Pa. is a first delinquency state.

The SOL in Pa. is 4 years from the time you first became 30 days late and never brought the account current.

A collection agency can continue to "try" and collect after SOL, but they "cannot" legally sue after the SOL has run.

If you certain that you are past SOL, send the collection agency a debt validation letter and then after they answer or 35 days from when they sign the green card, send them a SOL and cease and desist letter.

Always send everything certified mail return receipt.

Use the statutes that are listed on that page in your SOL letter.

Go to the home page of that site and do some reading on the letter templates.

I don't know how the first poster came up with that answer, but it is wrong. And I would suggest to the first poster - get rid of that lawyer that you are using before he makes things worse for you and find yourself a lawyer that knows statutes and the FDCPA.

If you have a mortgage and at least $10,000 in other debt check out: http://www.NoDebt4U.org
This company gets rid of all your debt, including your mortgage in about 9 years. No upfront fees. Does not mess up your credit. You can get a free 6 page debt analysis to see how it will work for you before you get on the program.
If you don't have a mortgage or don't qualify for the program you can purchase their Money Mastery Kit. It is a do it yourself program.
