If you feel that the baby is not being treated okay then try asking the court for temp custody and have the mother evaluated but try to get your son to understand you are concerned for him and the babys welfare and you are not trying to fully take the baby away from him.

As long as they are taking care of their child's basic needs than you do not have any legal right to take custody of their child. Is the mother being treated for bipolar disorder? Is she diagnosed? If she is not being abusive (physical, verbal/emotional, isolation or sexual) than you do not have the legal right to take custody. Just because your son is handicapped does not mean that he does not have the legal right to have and raise children. Does he have adaptation techniques? For example: a wheelchair, a handicap excess-able kitchen and bathroom, etc?

Ok first of all what kind of handicapism is your son? And why do you want custody just because she's bipolar? Is she on treatment for this? In order to do this you will have to have proof that she is a bad parent. Proof of neglect. If you file papers for custody on her for just her disorder the judge will not grant you custody. They might get dss involved for a few months to investigate her and your childs living arrangements to make sure there is nothing bad going on, but if the judge does this and there is nothing he sees unfit he will be very upset that you wasted the courts time on this and can fine you a large amount of fines and court fees. Trust me this happend to my kids father and he went to jail for discrimation agianst me and filing a wrongful suit, so if there really is a problem then by all means go to your family and probate court and file custody papers but if your only doing this to get her back and make her miserable I would beware cuz it will come back on you. Why do you need to take custody? A bipolar person such as myself may have difficulty with a baby, but with help and medication it can be done WELL!!!!

Why not HELP your son and girlfriend instead of taking thier baby away. Perhaps offering to share a home until baby is older (like 8 or 10).

Please try to work out a compromise. Taking custody WILL cause a rift that my NEVER mend!!!!

You would have to go to court, but that does not gurantee anything. Being bi-Polar(unless it's really serious) does not mean she cannot be a mother and car for her child. If you meet 200 people this week in walmarts, up town, the doctors ofice, school affairs at least 1 of them will be Bi-polar, and are able to go about a normal life as moms, fathers, businessmen/women with medical care and medicine ).
Besides if They are not married her and she is disabled her parents or guardian would be the one to make legals decisions regarding their daughters child, not you. See an atternoy. But if she is able to care ffor her child leave her alone. The child would be better to be with it's mom.

what? handicaps can't take care of their kids? be more specific. by this query i would say why do YOU think you are more apt to take care of a child? what's wrong with your son that he can't take care of his own child?

no, let me rephrase this... no, from what i can see how this is already been mattered, no you can't have custody. unless you can prove otherwise by furthering your statement and had already aquired a lawyer and talked with city hall and health and human services.

since you are asking this query here that indicates to me... that you're not fit.

ask any mediator or social worker.

which you've not done and this seems rather attention defecited. someone with an attention disorder who likes to jump the gun may also not be fit to attend to a childs needs who may also have handicaps themself in time to come.

I would talk it over with them and her side of the family also and let them know that you're willing to raise the child, but you want legal custody of the child. If they agree then go to your local child social service, Office of Family Support, they can lead you through the process. It best that you do this for the well being of the child. Wish you luck. Its not that hard to do. Its all about them agreeing on it.

Uhhhh you did not give a reason why this child needs to be taken. I am manic and with the help of medication I am a great mother. I have two girls ages 2 and 4. Is her illness not being treated?

Being handicapped and bipolar does not mean they are bad parents. Some people that are supposedly "normal" are terrible parents. If they need help, why don't you help them out instead of trying to take their children?

Is her bipolar disorder being treated? You didint specify a reason why she couldnt take care of her child. There are lots of people who have those disorders like ODC, and Bipolar and are taking care of children, as long as they are taking meds for it and seeking therapy they are capable of raising kids.

If shes unfit the you need to add more details.
