Is there a time limit when the IRS can not prosecute you for failing to file a tax report?

The IRS can still come after you for back taxes if they believe that you owe them from 1996 because you did not file a tax return. Generally, the IRS will not go back that far unless they think that fraud is involved or some other serious crime.

If you have been contacted by the IRS about this, then you will need to provide proof that you did not owe the IRS any money.

Three-year statute of limitations from the date you file the original return for the IRS to assess taxes against you - or 2 years from the date you paid your taxes.

Notwithstanding, the time period changes:

6 years if you failed to report greater than 25% of the income shown on your return - a substantial under-reporting of your income.

no time limit for auditing and collecting taxes if you file false/fraudulent returns.

10 years from the date of assessment for the IRS to collect.

After 5 years, the IRS will not audit you for that year, so it seems you are scot-free on that one. Congrats, the starving widows and orphans of the United States thank you for their hunger.

IF YOU POSSIBLY WERE DUE A REFUND, THEY DO NOT CARE AND YOU DON'T HAVE TO WORRY.

IF YOU WERE PROBABLY GOING TO OWE THEM MONEY, THEY POSSIBLY WILL BE CONTACTING YOU.

I DIDN'T FILE 2003 AND I KNOW I AM DUE A REFUND AND IF I DON'T FILE BY MARCH 15TH 2007, I WILL LOSE THE MONEY.

POSSIBLY THERE IS A DEAD LINE EVEN IF YOU OWE THEM AND JUST CALL THEM AS ASK THEM ABOUT IT. THEY HAVE AN 800 NUMBER.

If they have not discovered it by now chances are very remote that they will. They have bigger fish to fry like trying to nail all the democrats for more taxes.
