Thios happens all too often. My brother works at a legal firm that specialises with rta (road traffic accident) insurance claims. Even if there are no witnesses, his story will end up having holes in it, so you should win ultimatley. But you might not. Unfortunately, this is the way of our capitalist society. Your insurance company should hire a lawyer who should be able to crucify him in court, however.

Sounds like you are in California.
People canot sue the insurance co, they can only sue the person involved-- you and you will have to forward the suit to the insurance co. If he does sue the Insurance co., the suit will be dismissed and he will have to re-file and will be out of pocket the original filing fees
In any case, it is not uncommon for people to feel that they are not at fault for an accident, when in fact, they are. Conversly, there are many people who are money hungry and see Insurance Co's as a cash cow. Cooperate fully w/ the company and if you are totally not at fault for this accident, you will win.

You just cannot accuse Asians of lying, it is not Politically correct, 50 years ago it was accepted Asiatics never tell the truth but times have moved on and if you have to lose your no claims and your car because of political correctness so be it.

If you haven't done this already, go and photograph the road where the accident happened, and show the position of your and his vehicles. Make it plain that there were no witnesses to prevent him inventing one. Your insurance company will be aware of the kind of tricks people get up to, but they can deduce from the damage to your vehicle what happened. It happened to me and I won, but in the meantime, it makes you angry.Always carry a disposable camera in your car for this reason.

I had the same sort of problem a year ago with a Nigerian geezer.I simply told him if he continued to pursue it he would get sorted, and he would wake up one morning to find no car at all or worse...
Considering it was his fault that he had no lights on in the pitch black and was parked on a back rd in the dark says it all not to mention the car was on its last legs as it was a 1989 fiesta.
It shows he was looking for a mug like me..I simply had a few male friends of mine have a few words with him....he left it alone after that and dropped the claim!
You have too have balls with these bastards or they will just take you for a ride literally!

Thats why you have insurance - especially because of idiots like him - unless he has endless money he is not going to get very far - insurance companies will almost always win in court - dont stress he wont win
