Be careful, someone said "By law..." laws vary significantly by state... there is no federal law governing these issues.

What state are you in, I can look it up for you...

Pneumonia is usually considered a lower respiratory problem... however, the pathology of most pneumonias often include an upper respiratory infection at some stage (it is often a precursor and can exist concurrently) Where did you get him? A breeder should accept pneumonia in the upper respiratory clause... any responsible one would anyway... a pet store will probably refund your money too, I would contact the person/store you bought the puppy from and ask them.

Also, please contact me with your location, I can fill you in on the so called 'lemon laws' which about 30 states have enacted. Many of them have clauses for reimbursement of vet bills up to the cost of the dog and others for return of the animal.

I found this link... it summarizes the lemon laws by state...

Ok, I am really scared if the "vet" doesn't realize that bronchitis involves the bronchi, which are ONLY located in the lungs. And the lungs, because they are the end of the respiratory tract, are considered the lower respiratory organs.
WOW, what vet school did you attend? This is first year vet school knowledge! You might want to think about a refresher course!

I am also kinda scared that someone would pay $4000 for a puppy, especially a sick one. No pup should cost that much. And if you did pay that much, why aren't you keeping the puppy and having it hospitalized and treated properly? Clearly the people who sold you the pup weren't taking care of it before you got it. What makes you think that they are going to care for it if you give it back?

This is a sick dog, and it needs to have proper medical care. Please take responsibility for your pet.

No, it is a lower resp. infection that usually starts as an upper. For example, if the dog has allergies or sinus infection, or cold...it starts upper and the drainage goes to the lower. Even though I am not a pet, I have it right now and that is how mine got started with allergies.

BY LAW, there is a 72 hour warranty on the health of a puppy. Call the breeder, tell her that you expect the Vet bills to be paid. It is cut and dry unless something happened such as.... it was shipped by plane. That in itself could cause the distress.
You didn't say how old the pup is... that would help me give you better info as well as the breed.

LOOK UP PNEUMONIA ONLINE/respitory infection.
WHAT BREED DOG WAS HE?
IT SOUNDS LIKE TO ME, YOU BOUGHT HIM SICKLY. TO THE UNEXP. EYE, ONE WOULDN'T SEE IT. WAS HIS NOSE RUNNING OR WATERY EYES?
DID YOU GET A HEALTH CERT. WHEN YOU BOUGHT HIM? FOR THAT KIND OF MONEY, YOU SHOULD HAVE GOTTEN A HEALTH GUARANTEE WITH HIM.
IF THE BREEDER WANT TAKE HIM BACK & HE SHOULD DIE, BE SURE TO HAVE A FULL autopsy on him, should you have to sue. KEEP ALL RECORDS ON THIS PUPPY!
I bred for 24 years. I always gave a health guarantee on my pups sold. In 24 years, I only had one pup come back on me & I refunded the peoples money. It was a heart defect. GOOD LUCK!

yes, pneumonia is a infection in the lungs, there for it is in the upper respitory area.
I love dogs, but no dog is worth $4000 dollars.
Most family have so many important expenses, such as food, cloth, college, books, etc.
Severe pneumonia, may be you should consider putting it to sleep.
I am so sorry, good luck
