Of course. Why should anyone actually take responsibility for his/her own actions? Someone else is always at fault.

I think that if you were under the age of 18, it was required by state to wear a seat belt. However, the NTSB (Federal transportation bureau) has started a national requirement for EVERY passenger to wear a seat belt. The driver is ALWAYS responsible for the safe operation of the vehicle and passenger safety, regardless of what happens on the road. This can lead to a nit-picking question of who caused the accident and should you sue them, bottom line, wear your seat belt and don't drive anywhere until all of your passengers have complied to the rules of your vehicle.

In Ontario, Canada, at least, the driver is legally responsible only for people under the age of 16. If you're over 16, and don't buckle up, the driver is not liable if you get hurt in a crash. I don't know about the laws anywhere else.

Sure is. The driver is responsible to see to it that all passengers are buckled up. If that passenger didn't want to wear a seat belt the driver should've told em to take a hike (provided this wasn't the drivers kid, in that case, sit the kid down and buckle them up)

I think it depends on the age of the passenger. But, that is usually why you carry insurance....

Not if that person is over the age of 18, then it's there own fault. They are old enough to make that choice.

Yes, You should not even move the car until your passenger puts on his/her seat belt.
