The co. opened a new breakroom for us but part of the ceiling was an enclosed hvac duct. It made part of the small room have a ceiling height of about 5` 8`` I came in and took a chair at the provided table. While talking to my fellow security officers, I got an alarm over my radio,telling me to respond asap. I had to acknowledge by phone because radio was forbidden on that sensitive level. I rose quickly ,forgetting the low ceiling banging my hardhat. Though it saved my head from injury, my spine was compressed and I have been out of work on work comp for 3 weeks now. I am an armed nuclear security guard ,that must carry 35lbs. of equipment. I have no previous history of back problems and will lose my job if I cannot recover.

I am not an expert on this subject but I was injured on the job. I needed spine surgery but the workers comp. doctor went along with the utilization review boards ( URB )decision not to have surgery. I was in alot of pain having
to lay down most of the time still in pain.

You are profiled and if you don't fit the standard requirements for surgery under URB guidelines you won't get the surgery unless the WC doctor appeals. It is highly unlikely that the WC. doctor would try to override the URB because he is in their network. If you think you might need surgery and you have your own private insurance,
get an examination from your own private doctor. If your private doctor recommends surgery or treatment, go to your company's HR department and let them read your private doctors evaluation and recommendation. Your employer has the power to get the WC insurance to pay for the surgery. I know that for a fact. Only get a lawyer if your company is not trying to really help you. Go to your states WC section on the internet and read the laws before you go to your company's HR.

Know as much about the law before you start asking for help from the company or the WC Insurance. They will take you for a fool if they can. If you can write down and have the law codes as referance when you are talking that is really effective.

Your company and the WC insurance company will respect you for knowing laws and not having an attorney.
If you have an attorney right away, you will be more suspect of the seriousness of your injury.

If you don't have an attorney and it comes time for a WC doctor's second opinion you will have to use one the doctors in the WC insurance network. ( Network Doctor ).

If you have an attorney you get have a second opioion from a doctor who is networked with the attorney.

The surgery I had really helped me. Mine was in the lumbar.

Go for it and explain the problem in detail . Provide the relevant medical info and a report of any problems that might occur in the future with the current condition. They cannot sack a person on workers comp, but can provide them with light duties at the same pay rate. If they don't have light duties then they would have to provide you with a compensation pay-out for your loss of wages as well as for the injury itself. SEE A LAWYER TODAY.................

You should hire the services of a lawyer who specializes in on the job injuries.

Part of his advise would be to get a complete check up with a doctor who deals with injuries which take place in the work place.

The medical doctor will protect you from re injury by going back to work too soon, the lawyer will protect your legal rights.

im going through this right now.i hd surgery allready after a injury at work.they are paying for everything.evan my weekly wages,2/3 of it.i dont have a lawyer yet,but its coming becouse i was told i may need another surgury and might not be able to do my job anymore.

A lawyer is definitely a must do, provide thaty the company and you have not signed an abitration agreement. Best wishes to you.

yes get an attorney to handle your workman's comp claim. the laws in place are to protect the company, NOT YOU, so stay on it. they will cut corners with you and try to write you off and maybe even say you are not really hurt. get it taken care of now while everyone knows where and why you got hurt.

I would get an attorney. From personal experience, Workers' Comp will do everything they can to screw you. You need someone who knows what they can and cannot do.

Consult a personal injury attorney, we're not lawyers, at least most of us. You may have a case, it depends.
They will say its your fault and they aren't liable, you know how it goes.

I vote yes and a good doctor to back up your statements is necessary as well.
