Since my car was stationary and the other driver ran into it, I would imagine that I am not at fault. I was in plain view so there's no way that the other driver wouldn't have seen me if they only had looked before backing out. Want to get some opinions before filing an insurance claim.

This is what will happen. I was a former insurance adjuster and the worst that will happen is that you are held 10% at fault. They are majority at fault for backing up into a parked car. However, you were illegally parked. As a result, you have a little bit of blame but worse should be 10% your fault. So if you pay a deductible, you should be able to recoup 90% of the deductible.

As a former claims adjuster I can tell you that he is at fault. Your car wasn't moving and was considered a fixed object at the time of the impact/accident.
-The driver is at fault for improper backing and if this occurred on a public road/street then he would have been cited by a police officer. If this occurred in a parking lot or private driveway then no tickets would have been issued. Make sure you inform both your insurance company and his that your vehicle wasn't in motion and the other driver had the DUTY in backing to see a fixed object as that object could have been a CHILD instead of your vehicle.

I can't really say for certain as it may vary by state. If there was a sign clearly stating "No Parking, stopping, standing" you share 50% of the blame.

Good advice for everyone else... if your cell phone has a camera, take pictures right away and e-mail them to yourself. Write down what happened immediately and be sure to get the other driver's info. Police reports are not always required, normally there is a set dollar amount of damage that needs to be met before police investigate an accident.

I think you're both at fault. The other driver for hitting you and you for being illegally parked. Don't you have to have a police report too?

Your guess is as good as mine! My truck was legally parked, there was an accident which involved the death of a young boy because the Father had him unbelted in the front seat when he hit another car. My truck was in no way involved in the accident and Im getting sued because of where my truck was LEGALLY parked. Even the Trooper that did the investigation couldnt belive it! So where theres an accident theres a lawyer waiting to sue.

i hate to tell you this but i believe you are a fault because you were parked illegally. If you were parked in a legal place it would have been the other driver's fault.

You are at fault for parking where you should not park. Although you were stationary at the time of loss, your vehicle was where it does not belong.
HOWEVER....
Your insurance co will prob. deny the other person as they hit your car while parked
AND
His insurance co will deny you as you were Illegally parked.

My friend in high school sideswiped a line of cars parked illegally, he didn't even get a ticket
