No such thing as a "Military" divorce... divorce law is covered by the state in which you reside. So it's the State that makes the rules.

NOW... the miltary can make your divorce interesting... they WILL take child support and or spousal support directly from your "check". The service will ENSURE you comply with court orders and such.

For ADVICE... contact your services Legal Dept. or a civil lawyer. Depending on assets and property and kids... get it over with !!

If one of the spouses is overseas, then the divorce can be put on hold until the spouse comes back and can obtain a lawyer for the divorce.
Also, if you are in the military and divorce, and have children, you will have the option to have the child support taken directly out of your pay and sent to the spouse with the children.

no such animal as a military divorce. Divorces are based on the laws of the state in which you file. Only a court order will be accepted for things like alimony, child support or retention of minor children under medical benefits.

No such thing as a Military Divorce.

Divorce (and Marriage) is a State function. The military has no say in it.

Now the Military will impose some things on the servicemember like spousal support while you are seperated and child support. They also have Family counciling centers to help you (or her) with the situation.

You need to go through counselling and classes when your in. They try to save the marriage. They say that you need to set an examle for the rest of the Americans. Atleast in the Marines its about Honor courage Commitement. So if you get divorced you dont have none.

There is no difference. You still have to get a civilian attorney to do everything and it will cost an arm and a leg. Mine still doesn't pay child support.
