My stepfather was deported two years ago. He and my mother have been married for 10 years. He had an immigration lawyer who never completed his paperwork, even though she was paid. She is telling him she is still working on his paperwork, but I don't think you can return once you have been deported.

Yes, your step father can return to the United States, but it is a long and hard process. On the paperwork he recieved when deported it should say how many years (if any) he was barred from returning to the US. If he was barred, then it requires a waiver to be filed on his behalf "601 Application for waiver of Grounds of inadmissibility." I'm in this process now. There are papers that have to be filed before this one, and after each there is a long waiting period of about 7 months to a year each time. You can look up on the immigration site what needs to be filed, the fee and the time it takes for each form. Try the link below for further information. First report that lawyer to the bar association in your area. Once deportation takes place it will be difficult getting back. The waver is the only hope. If they have children together it might be easier. Normal waver takes 6-8 months. Your best source of information is uscis.com. Ask around, find a another attorney. Most will give you 1 hour consultation.
If waver doesn't work, I'm afraid she is barred for 10 years.

I think you can try again after a certain amount of time.I'm not sure as to the amount of time but someone on here will tell you.i think you also cant have had any more trouble with the law during that time after the deportation

It depends on what the reason for deportation was.

I would think that if he commited no felonies, and it was an administrative issue, that yes he could return.

Perfect example US immigration system is screwed up. He can probably return in 10 years, but why dodn't you find another lawyer?

depends on why they deported him, it is a slow and hard process, but he must wait 10 years to apply for come back

get a different lawyer and sue the first. I'm sure he can return with proper litigation
