Unfortunately, the laws for DUI are Draconian and unyielding. The penalty for what you MIGHT do because you are drunk is much more severe than the penalties for actually causing an accident and hurting someone.
If this is your first DUI and you weren't above 1.5, don't even bother with a lawyer. It will just be a waste of your money. Follow whatever punishment they give you to the letter, and you'll have your license back one day. You MUST jump through their hoops or you will not drive again.

I did, blew .08, which is the legal limit. Had 3 beers a t afriend's house and waited an hour, but I guess I should've waited an hour more. Don't let the judgmental folk get to you. Everyone makes mistakes, even the people on Yahoo! Answers.
I'm in California, I got 3 months of classes, mandatory AA and MADD meetings, plus I was fined 1200 dollars.
It is a learning experience. Just make sure you make plans about a ride home before you drink, when you're drunk, you never make good decisions.

Has to have a reason to stop you I.E. he saw you breaking the law.
Has to be trained in the use of the equipment and be Certified to use the equipment at the same time.
Did they do multiple test on you with more than one machine you want all documents in regard to that.
Did you request an administrative hearing at the DMV if your state does that do it you may keep your license.
How much time passed between the arrest and the blow test or blood test that is important also.
Did you drink or eat anything after the officer arrested you.
Are you an alcoholic you may be insane.
OK check times for your state for all testing and if you were offered all the correct options at the time?
Did you pass the field test and the man said you failed?
Finally request a continuances you are not prepared to defend yourself.

Yeah, I had one. I actually do suggest getting a lawyer. Luckily, the rugby team I played for at the time I got a DUI had a lawyer as a coach and he did my work pro bono. Anyway, I ended up getting a fine and 24 hours in jail. I had an administrative hearing with the Department of Motor Vehicles for the revocation of my license. My lawyer took care of that hearing for me. I just sat outside the room while he talked with the judge and the arresting officer. I ended up keeping my license which was a huge relief. I think I would have lost my license if it weren't for the lawyer.

The DUI laws are VERY rarely inforced in this country and people who do get charged with them end up with a slap on the hand.
Six years in prison for murdering someone while driving drunk. Give me a break!!!
The person should get a 15+ year prison term then a full loss of driving privilages for life.

if this is your first you wil get a fine lose your license, have level one probation and have to complete DUI classes. Do all you are supposed to do or you will go back to court on a VOP violation of probation and they won't be very nice, may include jail time.

I got one 36 years ago. I just paid off the judge with some money under the table and he let me go.
