Why is this in "Singles & Dating". Are you dating this child? If so then what you are doing is very wrong.
1. Yes you can give the fudge to the child if the parent or legal guardian knows you are doing so (so you're not a stranger and the kid's parents know you).
2. Yes, you can get locked up for dating a child. It is called being a paedophile and you can get locked up for it if you are found out.

My mum used to give me fudges as a kid, never did me harm, but not every often. Too many treats spoil kids.
