Can you be tried at court on your first offense if you have already been for your second?
If you get 2 tickets in a 4 month span for driving without a license, and you go to court for the second one before the first and get a first offense fine. Can they try you for your first ticket as a second offense? This offense carries the same sentance as a DUI, and i know tha tif you get 2 DUIs and they schedule you for court on your second one first you can get it all thrown out??? Help me i cant get an answer for this!

Here's a clue: don't get tickets and drive drunk and generally be a public nuisance and you won't have to worry about this.


I hope they lock up whoever needs this advice for the rest of my life - the world has enough pains in the butt without the homegrown variety.

For whatever reason, the court completed your "second" violation before the one committed on the earlier date. The matter, however, relies on the court resolutions, and not on the date of the violation..

In the eyes of the court, the date of the violation is irrelevant. By the court date, you have been found guilty of the same offense before. Therefore, it will become your second offense, unless you can prove yourself innocent (which I doubt).

Violation is what it is,if the Judge considered all the violations at the same time when he made his decision.

If you commit a murder in one state and then the next month another in a different state......you still have to answer to the charges,regardless what was committed first.

Maybe you should call a lawyer....they give free consultations.
You will probably need to retain one as well. I had a pending DWI knocked down to a DWI as minor (I'm 23 years old) which means it does not go on my record, nor do I give up my license, nor did do any community service or probation. But, I paid out my *** for a REALLY GOOD lawyer.

It's when you committed the crime that determines whether it is first or second, not when you go to trail. It is the number of offenses, not the sequence. Bye-bye.
