He was driving down the highway at speeds excess of 90 mph, while weaving through traffic. After stopping at his house Foley got out of his car and started walking towards the off-duty officer. As Foley was walking towards the officer the passenger in his car got into the drivers seat and started driving. The officer identified himself as a cop and shot a warining shot, when that happend the passenger started driving towards the officer, then the cop shot two times at the car and then shot Foley who had his hand on his waistband. That is why he got shot.

He was shot for failing to obey the repeated orders of a police officer and acting in a threatening manner towards the officer.... If you don't want to be shot it's probably a good idea to do as you are told when a cop draws his weapon on you. But I guess when you are jacked up on alcohol and 'roids it kind of clouds your judgment.

To my knowlege it was because he reached into his pocket when the officer told him to raise his hands.
