The death penalty is not a federal issue. Congress has no authority to eliminate it at the state level. Congress may remove the death penalty from the federal sentencing guidelines (for federal crimes only) but that has not happened that I can find.

Why do you think Congress has abolished the death penalty?

The death penalty is decided on by each state not the federal government (at least not at the state level)

the senate has not outlawed the death penalty,the individual states each have their own laws about the death penalty.

not unless you are speaking of your state senate. The Federal government has no such law.
