I want a divorce but my husband refuses to give me one unless I give him the kids! He lives in Italy and I would move back to the states, we both feel we will never see the kids again if the other takes them. The biggest thing is he really doesn't want the kids and has told me in the past that he wants them just because I want them and he wants to hurt me. We have been married just over a year and I can not stand him. I couldn't stand him when we married but I married anyway for our son. Now we have two kids and i want them both! But just to be mean to me and make me suffer he won't allow me to even leave this country to visit home because he thinks I will never come back and I will take the kids with me. What are some things that I can do to A) get divorced B)get my kids????
Please help dire sitution here!

This sounds like a job for an international attorney. You need to know the divorce laws in Italy. You will also need to have body guards for your kids if you don't want him to take them and hide them from you. Get sound legal advice and follow it.

I am going to be honest from a point of view of a child that went through the California Legal system. It may be different there, but Unless you can prove he is an unfit parent you will be getting joint custody. If you go through the divorce, your husband can and probably will try to find a way to make sure you can't take them nack to the "states." It sucks to be a child in the middle of a legal dispute. If joint custody is awarded it will probably be something life half with him half with you. I would definatley bring up the fact that you are afraid he will try to hide them from you when he does have them. It is all up to the legal syatem. But I would file for full custody.

I will assume you are a U.S. citizen... Your husband refusing to allow you to travel is illegal contact the u.s. state department they can help you more than anyone on Yahoo can...

Start by contacting the U.S. Embassy in Italy and go from there...

Think outside the box there is always more than two options but sometimes you need to change the perimeters of the situation to create new ones...

You need to get a divorce Lawyer. And my take is you two are using those poor kids to hurt each other. That is so wrong.

Why is it that women do this??? You say you couldn't stand him when you got married but you did it anyway and then had another child in such a sick relationship. You should do whatever is best for the children. If that means you stay in this situation YOU created than so be it. What will the children do without a mother. How old are these kids. It's time to grow up!

You need a very good attorney.
Keep yourself level headed and take good care of your children.
It will be up to a judge to make judgment.

A. choice is yours
B. Best interst of kids....make sure each parent sees them, nothing wrong with you wanting them to raise, but he is their father . Don't make this a compitition your little ones are not a battle ground.

Unless you are proven unfit chances you'll get full custody of the kids.

Divorce him- he's just using scare tactics.
