John have been working on 2nd hand car dealer for over 10 years, one day, a customer , Peter told John that he was looking for a 2nd hand Benz with mileage not more than 20,000 kms. Then John showed him a Benz and represented the car run for 15,000 kms. and good condition though it has been the age of 6. then Peter brought this car for 100,000
One year later... Peter instructed other car dealer for resell this car. for evaluation purpose, that dearler did a detailed check and found the car milo meter had been tempered with. Peter was told that the car had run for at least 120,000 kms and the market value is 20,000. Now Peter wants to claim against John

For a start how do we know that peter hasnt tampered with the milometer i would think peter would have a hard time trying to prove that John had done it .

Of the top of my head. John or the dealer can be charged with fraud if you can prove they altered the speedo or knew it had been altered. As it is the car does not meet the description which is breach of contract. Peter can sue for damages which would be the difference in the sale value of the car now and what it would have been had the mileage been correct. John could claim in court that he was not liable as he did not know and had bought the car himself in good faith but the court would be unlikely to accept that as he is a professional and should have checked that before he sold it.

Peter needs to file a complaint with the state for odometer tamering.
