I had a problem with my toilet, so I called the manager/caretaker. He then told his daughter in law that there was "Crap" all over the bathroom floor, and that I didn't clean it up. COMPLETE LIE!! Then I had an inspection, and this same guy told his daughter in law and others that there was human and animal "Crap" all over the bathroom and all through my bedroom. LIE as well. He then called DHS on me and they are coming back tomorrow to "Inspect" my place as I wasn't home. My Place is clean, and my 4 year old isn't in any danger. Does he have the right to lie like that about me to other tenants? Also, does he have the right to talk about other tennents with his daughter in law and others in public at the complex? any help would be greatly appreciated as I meet with the landlord tomorrow.

Well once DHS gets there you will be proved right and he'll be proved a liar. Then you can ask them about if there will be ramafications for him making a false report. I am sure you can put in a complaint to the housing authority in your area, or at the very least his boss. He is the manager but not the owner, he has to report to someone, he get s apycheck from somewhere.

This is an odd as hell question. If he called DHS, he must actually believe that you have human crap all over the place. It is one thing to tell other people about it (yes, it can be considered illegal, if you can get a court to buy that it was in retaliation for something), but calling DHS is just plain stupid, unless you have good cause.

This sounds like it wasn't in retaliation though. It sounds like he believes you have crap all over your apartment. Any landlord worth his soul knows that calling DHS without good cause could bring about a world of trouble.

He is allowed to have his own personal opinion of you and to share it with others, much like you have the right to post your version of events here.

However, he has been filing false complaints about you. That is actionable providing you have actual damages, but it could be expensive.

Long story short, years ago I had a crazy landlord who did the same thing to me (filing false Dept of Health complaints, calling the cops at 3 a.m. claiming I was suicidal, false animal abuse complaints, etc).

For most of the false complaints, I had no proof that it was him ... but the health inspector was different.

The health inspector who came to my place was beyond pissed that he had his time wasted by an obvious bogus complaint. My place looks like Felix Unger lives there. I am compulsively neat and clean. I am the kind of person who sterilizes my silverware for fun.

He was so pissed about being jerked around by a nut case landlord that he gave me photocopies of everything he had, including my landlords letter detailing all these supposed unsafe and unsanitary "conditions" I had in my place. He also gave me his findings report with detailed notes about the conversations he had with my landlord vs. what he actually observed during his visit.

It was one of the things I used to start legal action against my landlord for harassment and a few other things. It cost me 2K to 3K in legal fees up front, but in the end I walked away with almost 9K in free rent and damages.

He has no business lying about you. Tell the DHS that and if there is a problem talk to authorities.

He shouldnt' be spreading any lies about you. What goes on in your apt. is your business only. I think you can complain there are companies and groups that help renters.

If it was in writing it is called libel, but verbal is called slander. Both are illegal, although slander is harder to prove because (duh) it isn't written down.

Good luck with this! Sounds like a real @$$hole for a landlord...........
