They had two children. His wife got the son and he got his daughter, so he didn't have to pay child support., just take care of his daughter. His daughter is 19 years old and was planning on going to college this Fall, but she couldn't find an apartment near the college, so she decided to sign up to go in the Spring instead, so she will have more time to look for an apartment. Now my son is saying that since she didn't sign up to go in the Fall, that means his daughter is emancipated and now he will have to pay child support for his son. I thought that as long as his daughter signed up and is going in the Spring it would be okay. How could he send his daughter to college and pay child support for his son too? Can someone please clear this up for me.

First of all he needs to look at the divorce decree to see what it says. Legally he would have to pay child support for the child that is not with him. But it is always good to check the decree and confer with an attorney.

Time for him to read the fine print on his Judgement of Divorce. It's usually stipulated what will happen when one child reaches the age of majority. If it's not stipulated, the ex can take him back to court for child support. Technically, if the daughter didn't sign up immediately for school, she is considered an adult. However, if she signs up prior to her 19th birthday, then she's not. Hope this helps.
