my brother has a trailer on my land he was living in. he got behind on payments the company he was buying from told him he need to move they was coming to repo the trailer. that was 4 months ago they came and changed the locks .it has been empty since june 1st we have called they won't come get it they have it on the internet for sell. we was told they had the right to leave it set there till it's was sold what should i do?

If it belongs to a company..you can charge them rent..because it belongs to them and it is on your land...if then they don't pay..you can have it moved and put in storage at their expense...plus the rent they owe since June 1...but i would talk to a lawyer about this situation..every state has different laws. But i am very sure you can charge them rent because it is on your land..

Do you belong to a homeowner's association? You should contact them if you do. Usually your local homeowner's association deals with things like that.

If not, I would contact the city. Sometimes state laws and city laws differ. Go down to your city hall and find out. Look up your rights for the state as well and compare. Usually you can find loopholes that way.

Also, find out the address that is on the title to the property. I guarantee you it's not your address, becuase you said he moved his trailor there, right? The law is so tricky, but there has to be a loophole. I hope everything works out for you.

They do NOT have the right to leave it there. :) Simply remove it yourself and leave it on their property, if nearby. If not, start charging them a storage fee while it is on your land. Have a judgement issued against the company, with your local county courthouse, for the back land-rent owed. They'll remove it pretty quickly, if the law gets involved and it becomes a money-losing proposition for them.

I agree with the other 2.....go to your municipal court and file a civil suit against them for rental of your property and back rent owed plus atleast 16% interest until paid. I would not move it though, just leave it where it is. It will only cost you about $30 to take them to court anyway.
