It depends on the foreign power. An American can join the French Foreign Legion, or the British Army or the Australian Army and, possibly, some other armies... and, just as long as they don't fight against the U.S. they are within their rights to serve in a foreign army and won't be considered a traitor.

Generally you can't be fighting against the US government, you can fight with our alies. Like an american could join the british army to fight in Afganistan. You couldn't join the taliban or another group that was fighing against the US. A country that is in a fight that does not involve the US at all it is harder to say. It would depend on how our government felt about taking you back, but there is always a chance you would go to jail.

As long as they didn't fight against the US, it would not be treason.
And the US can't declare actions in other countries to be a violation of US laws, unless the US has some authority there. As long as the fighting did not occur on US soil, or on a US territory or military base, then the action was not conducted within the jurisdiction of the US courts.

also i think participating in the fighting isn't illegal if you don't belong to thier army..I heard somewhere that if you join a foriegn army you give away your american citizenship

It is only illegal if you are fighting against the US. That would be treason. Speaking of treason, I don't understand why Jane Fonda was never charged with treason for her actions in Vietnam. I guess it's because she's famous and famous people never really have to pay for their crimes.

Its only illegal if they are fighting AGAINST the US. A lot of Americans fought in the RAF in Britain in WWII.
