Exception: a studio or other entity can own the rights to a stage name. Tina Turner -- whose real name is Anna Mae Bullock -- had to acquire those rights as part of the divorce when she split from Ike.

actors sign contracts with the production studio that allows the studio to use the actors voice, name, face, or anything else the actor gives to the project as long as it is to promote the project. They usually also agree that for a period of time, while promoting the movie, they will maintain the characters image. Johnny Depp cant shave while he is a pirate, the Rock cant wrestle while promoting a movie. The actors have to play the part even after filming and the studios make them sign saying they will do certain things but after the contract is up, thats it.
The Rock did have a situation where he had to buy the rights to use the name 'The Rock" from WWF because that was a character that wresteling created.

That's how studios used to work. Now they use the name and likeness of an actor for the specifc project they are workking on. If there is no contract and the studio goes ahead and uses the voice, etc. the studio can be sued.

They can have the rights to a character played by an actor, and the likeness of that person as that character. And you cannot use someone's name or likeness to promote something without their permission (and usually compensating them).

I heard that pierce brosnan was not allowed to be in films wearing a tuxedo while he was still considered "James bond" if he did a film and a scene requiered a Tux, he could't wear a bow tie.
