i live in a housing assocation house on an estate and have had problems with anti social behavior damage to property cars groups of uncontroleble tenents children bullying and abusing my children my 7 year old has been bullyied and beaten bikes stolen i could go on and on i am now in the prosess of moving because ive had enough ive even paid someone £2000 to exchange home with me i have tried to contact my housing association and complain many times only to be ignored they dont even get back to me i feel this is a brech of tenentcy contract which promised to give us a safe enviroment to live can i sue them for 7 years of hell

It appears to me that you live in the uk so that is the law I shall discuss.

This is very difficult because the housing association cannot be held responsible for the actions of others outside your property. If criminal offences have been committed by neighbours then it is a matter for the police.

I cannot seem that there is any breach of contract here in their duty of care to you because it only applies to your tenancy and the upkeep of the property.

Neither can I see a tort being committed by the association.

I am of the view that unfortunately it would be very difficult to bring a case against the association on the grounds that you have stated.

If you had purchased the property recently then there is a duty of care by the vendor to inform you of bad neighbours etc. I don't think this applies to tenants

Consult a solicitor but I don't think you have a case.

If you have been to the police when all this has happened they should have a list of the offences as long as your arm and that will go against your housing association because if you have reported it and they have done nothing it is their problem, also if you went to the police alot in theory they should have got fed up with all the complaints and made a to the housing association themselves

Yes you can and should!!!
The Housing association have a duty of care which goes beyond the normal duty of care we all owe to our neighbours.
The association owe a higher level of duty of care to you due to your 'special relationship'
You have a very strong case that should see you compensated fully for your hard ship so do your self and your family a favour by making an appointment for a free half hour consultation with a solicitor.

You can either move out and pay an open market rent or sue the not for profit organization that has put a roof over your head. Look out for those amblulance chasing lawyers who do all the suing for compensation parasites.

Yes, you can sue anyone you choose and as long as you can prove what you are suing for, you should win your case.

Really sorry for your situation but I can assure you that you are not alone in this predicament.

You haven't mentioned whether ethnic minorities are part of your problem but if they are the Police will be most reluctant to get involved for fear of raising racist issues.

You should contact watchdog and see if they can't get the housing association to pay up for the cost of moving. Definitely contact the CAB to see what advice they can offer.

No offence but why did you put your kids through that for 7 years?
you should have gone into the private sector, you wouldnt have to put up with such crap then, and it is possible to get out of such a situation even if your poor and with kids. I know ive been there, and worked hard to get out of it.

Seriously I would go the citizens advice it sounds really awful and I know that most of what goes on goes unnoticed. Im sorry for your life being a living hell , go there and see what they can help you with.

If you can cite rules in your document book that have been breached, you may have a case. Get a legal consultation to be sure.

no luck theaten to sue them
next stop police no luck again threaten to sue and write to chief constable of your area
soliciter next stop
still no luck tell police yobo's have no tax on car ......they will be out in swarms
last resort get gun shoot all the bastards

I really wish I could solve this for you.........but yes sue them for breach of contract etc etc etc
