A sales rep comes in and a order was placed with him, after he left, we found that we had 50 pair of Rayban sunglass and did not need the order just placed. The rep. wrote up the order and we did not sighn for it. Later after makeing the discovery we called the rep and asked to cancel the order. They were sent anyway. According to the customer service rep. that answered the phone, we had 90 days to send the order back, we did right away. It in turn has been sent back to us, we did not ask for it. Now somewhere I beleive there is a Federal fair trade commission act that states if you did not order the product, {wich remember we had sent it back in time} then you are not obligated to pay for the product. Is anyone aware of such a ruling? Do I have to send them back? Do I have to keep them and pay for them?

nope. They sent them to you and you didn't want them. Once you sent them back you are in the clear.
Federal law also states that anything you receive in the mail is yours. Weather you ordered it or not.
As for paying for it. If you did not sign any order form or sign any receipt...You are clear.
It would probably be a good Idea to keep the product though. If you return it again they might charge you for it anyway. Some companies are disreputable like that. This way you have a bargaining chip to use. "Take off the bill and you can have your product back".... You should do fine.

You're going to love this: according to the Federal Trade Commission (see the link below), not only do you not have to pay, because the vendor does not have a signed purchase order for the sunglasses, but you have no obligation to return them either -- because you didn't order them, they can be considered a free gift. If you really don't want them, you can ship them back saying so, but if you could actually use them, just send a letter to the vendor telling them that you're keeping them as a free gift -- this will discourage them from shipping you unordered merchandise in the future. Contact the company, tell them you received a shipment that you did not order and ask them if this is a complimentary (free) shipment from their company intended to introduce you to their products at no charge. If they say "no", then ask them to send you a pre-paid shipping label or give you their Fed-Ex/UPS number so you can have the items shipped back to them. If they don't give you that info, you can ship the items back at your expense but be sure to have a signed receipt of delivery done by whomever you ship through so you have proof the order was delivered back to them.

In the future, do not sign if the items were delivered by a company like UPS or Fed-Ex: simply tell the courier you're refusing to accept the box and they'll send it back. If it's through regular US mail, cross out the barcode at the bottom of the shipping label and drop it off at the post office with "Refused: return to shipper" in big letters across the front of the package.

If you didn't order it and you didn't authorize the order then you are not liable to pay for it.

HOWEVER... if you have the merchandise then you DO have a responsibility to care for it until you are told by the shipper how they wish to handle your sending the order back. In other words, you don't have to pay for it but you do have to keep it safe until given orders by the owner what to do with it.

Call them - tell them you cancelled the order and tried shipping them back. Request an RMA # (return materials authorization) and maybe even a shipping label. Let them know you will not pay for them, so unless they are going to let you have them for free, they need to let you know how to return them.

No Sir, when you have not ordered no one would send you any thing and you are not at all liable to any amount. But if sender proves that you had ordered then only you will be liable.

Send it back again stating that you do not want it and also tell them if it is sent back to you again you will not pay for it and you will keep it

Send it back again...and if its returned...contact the sales reps BOSS...tell him what happened...but it sounds like you might have to have a sale on Rayban sunglasses

If you put the glasses on and they look great on you..go for it!! It's not about the name but how it makes you feel! I say go for it!
