I divorced my ex 5 years ago and he hasnt paid much child support. The Attorney General isnt much help. I do get some child support through one of those places that gets a chunk out of it if they can get you money. He knows nothing will happen if he doesnt pay so he has quit paying. He works under the table so they wont take it out of his check. Does anyone know of any way I can make him pay. I live in Texas. This just really frustrates me that he is getting away with it.

Unfortunately reallynot much you can do. The good news if it makes you feel any better is that if he is court ordered to pay you a certain amount then it is adding up and even once your child is 18 it's a debt he will have to pay.

Because he won't pay he will never have a decent job, never make money to retire on and he will probably end up with no license to drive and there are other penalties for non-payment.

Good Luck, I hope you get what you deserve.

I swear I'd be rich right now if I started teaching a class on this. Honey, this is really easy to do. If you have a court order for child support in place, march into your courthouse tomorrow and file a contempt motion for non-payment. It's free to file, but you will have to pay to have him served. (Sherriff's dept charges about $30). They'll give you a court date in which to appear. At this time, he'll have to answer to the contempt charges and unless it's medically related, he won't stand a chance. They'll give him two options. Either go to jail now, or sign a stipulation that if he doesn't pay, he'll be sitting in jail with work release privelages. Then if say in about a month, you've still received nothing. March back into your courthouse, file another contempt motion, have him served again. At this court hearing, if he even shows(most times they don't), he'll be arrested immediately and won't be able to bond out. Instead they'll make him sit until he comes up with a good chunk of the arrears first. If he's a no-show, an arrest warrant is issued immediately. Now that just works for the monetary aspect. If the ex is in arrears over $5,000, you can put liens on his vehicles, his house, they can revoke his driver's license, hunting licenses, etc. You can also file to take his tax return each year, but that must be done by August and the clerk of courts will help you file that if you ask. The more you squeeze his livelyhood, the more likely it is that he'll just get a job and start to comply with his obligation. The good thing is, is that as of late, they've made it really easy for custodial parents such as yourself in situations like this. I wish you luck!

I would recommend you going to Department of Children services as well as contacting the IRS and reporting the company he works for. Stir problems if you want answers. Also, not sure if you knew this or not but most states have a law that states "ability to pay" versus how much money they actually claim. Get on line and surf Texas Child Support laws, a lot of times you can even get free legal services. They will make him pay and if he falls behind he will spend time in jail! Educate yourself, a single parent is hard enough, show your children how to fight for what is right starting in your own home!

Its really tough, but the only thing you can do is keep going after him. Go to court and ask them. He can go to jail for not paying support. If you have a support order and he doesn't pay, its a violation of court (contempt) payable by jail time. I know of someone who went to jail and had to pay x amount of pack support as bail to get out. The court system knows that people dog the system so they come up with an amount to be paid regardless of whether he has a job.
Also, here is a website that has more info in your state: http://library.law.smu.edu/resguide/support.htm

Talk to a lawyer. Also contact companies that help get you child support. Search on yahoo there are some companies that can help women/ parents get child support money if there is a court order for support in place and you dont receive welfare. If you need to go on welfare (if you are able to receive it). Most states have cracked down on welfare and will hunt down and legally attack the father for the father to pay back welfare office. So the welfare office can take care of the whole issue for you, if you have welfare.

I live in Nebraska, here if you don't pay child support they will take away his drivers license and next they will throw him in jail. Consult an attorney, or contact your county attorney's office, usually located in the court house. Do your best to follow up and get your child support, if you do nothing, he wins. Good Luck!

I live in Tx too. I gave up on the AG, they will never do anything. The only way I got it was to hire a private attorney. They may be able to put a lein on him. It's hard though if he works on the side. I feel your pain. The good news is that one day the kids will be old enough to understand that their Dad is a jerk and didn't pay for their support. He will never be able to gain their trust or respect again.

Turn him in... let the state know that he's getting paid under the table... the government frowns on that... they're being cheated from his share of Taxes. Sorry you had a child with such a scumb bucket.
