For an appeal of administrative action go to your congressman's office, than tell them you want to take it to the Circit Courts of Federal Appeal.

Notice, that the constitution doesn't state that being in the military is part of your rights.

Absolutely not. And don't start crying saying "they should have the same rights as everyone else." The fact is, the military has to work harder to accomodate homosexuals. That equals my tax dollars. Perhaps if a vote was taken, where we could leave it up to the majority, and the majority said yes, then absolutely.
Of course the only problem with that is the majority would say yes based on some half-baked ideaology. What gives?

First off, let's understand something right off. Gays have ALWAYS and will ALWAYS participate in the military.
What you're actually asking is if gays should be "Out" while serving in the military.
My responce is a resounding, yes, what should it matter?
As a lesbian and Ex-Navy, I can tell you that my motivation to join the military was the same as it is for anyone else. I wanted to serve my country because I believed in my country. I wanted to give back in one way I knew I could.
I also joined as a personal challenge to myself, to see if I actually could do it.
I learned a lot about myself and my streangth as a person. I'm pround of my service...
I'm simply not proud of what the service does to certain people. I have very personal feelings about my time in the service, some good, some not so good.
But I will never let anyone say gays don't belong in the military, let alone women or any other able bodied citizen of sound mind and without a criminal record.
What recruiters are being asked to allow to join now is simply a disgrace to our military and our country.

Yes they should be allowed to go into the military if they choose. Our military is a Voluntary enlistment, and with the numbers dwindling on the recruitment that they have, why not let the people that choose to go in, fight for the country that they also love and live in.
Just like straight men and women, what they do personally is between them and as long as it doesn't shame the military then it shouldn't matter. Not like there people, gay or straight are out in public doing this stuff. It shouldn't matter who your fighting next to. Your both on the same side and you need to work together.
As with Mr. Curious's comment about being allowed a certain rank, that is discrimination based on sexual preference. A lot of people in higher positions are actually gay. Why? They put a lot more into their jobs and such. Most don't have children to take care of and such, so therefore they put their time and effort into something else. So not to allow them to go beyond a certain rank is just despicable.

There are not only gays in the military but also transsexuals in every branch of the service,
This includes all special ops, and every rank up to general and admiral. There are so many of us who came out after serving in Nam or anytime since that the VA treats Vets for GID
(Gender Identity Disorder) Hormones Psychiatry, Endocrinologists, Gynecologists, Every thing except surgery. There's a lot of us that served honorably and heroically and some that died without any body knowing who they really were, the biggest fear most of us ever have.

In every war that has existed in time's past; so have gays in the military. Those who would mount an argument against homosexuals in the military are sorely cheating themselves and their country's military success.
Currently, many soldiers are being dishonorably discharged from the military duties, because they are simply gay. What happen to the don't ask; don't tell policy. Many people are kick out without ever being found to be gay through actions or behavior; but simply rumor.
At a time in this country where our recruitment is very low; why discharged those willing to aid; even to the point where their freedoms or limited. If gays are not allowed to server in the military, they shouldn't have to pay taxes. Remember; no taxation without representation.

If ANYONE-Gay/Straight or otherwise wants to fight for a country that obviously doesn't give a damn about its own, let them! Now before everyone goes on a tyraid here, think about our veterans who are sleeping under bridges, denied health care, still called baby-killers...etc...but we (as a country) jump through our *** to take care of the very people that are killing us in wars we shouldn't be in in the first place!!!

I think We should be able to be in the military. In the military they don't discriminate on race sex or religion but they discriminate on your sexual preference. If they don't tolerate discrimination why do they still discriminate? I think that is immoral for them to discriminate because we are gay but not for race or sex or religion. I wanted to join the army when I got out of high school but the recruiting office took one look at me and told me he wouldn't even let me fill out the paperwork. WE have the right to protect our country as much as straight people.

Yes, if they want to be. there shouldn't be a free ride for anyone actually - that way we'd have less war. It's always easier to send someone elses kids; a bit different when it's your own.

I think that it doesn't matter what your sexuality is. If you are a good service member, then you are a good service member. Who you have sex with and choose to spend your life with should NOT in any way play a part in what job you should or shouldn't have. If you are qualified, you're qualified. PERIOD!

There is no reason why a homosexual person who chooses to serve his or her country should not be alowed to be in the military service, and openly!
