You have a legal right to defend your position in any case, criminal or civil. I a CPS case you need to ask yourself what is best for the children. In some cases a little time away so the parents can get their act together is a good thing. It is difficult to admit that things are not the way they should be when you love your children but it takes the guts to know what is best for them.

It is always all right to defend yourself against a charge of any kind. The accuser must prove his case.

If, however, you know you have no true defense and the evidence will indeed convict you of the charge, you would be well advised not to anger the court by making it go through futile motions.
