It is about 3 feet tall and has small, staggred waxy looking leaves and currently has little black or purple berries on it.

Need more to id. that plant.You should give us :size, colour,scent of flower and when it blooms,in the shade/sun,
size of berries,edges(smooth/dented) of leaves etc...etc
