It should be referenced in the purchase agreement. If a home warranty was purchased, then the purchase agreement should specify whether the buyer or seller is paying for the home warranty and a home warranty document should be provided at closing stating: name of company providing coverage, covered items, items not covered, how to file claims, etc.
