I don't know what to do...I just received two letters saying that either i'm being sued or a judgement has been entered against me from a creditor that i don't know and for an amount that i don't owe. I was never served any papers to appear in court nor have I received any collection notices for this amount. I don't know what to do...i don't want them to garnish my check or take any money out of my bank accounts. Any information would be greatly appreciated!!!

TIA!

Check with your county court clerk and see if a suit or a judgment was filed in your name. If there is a judgment filed, go and request a full copy of that file. Look to see what the process server stated as far as serving you.

If no judgment or suit is filed, send the company a debt validation letter. Send it certified mail return receipt.

Pull your credit reports, from each bureau, to see what is listed on them.

If there is no judgment or suit filed, I would strongly suggest taking all of your paperwork to a lawyer. Claiming a judgment or a suit filed when there is none is a violation. Plus, I'm sure if they are reporting on your credit reports, there are plenty of violations on the reports also.

Also, if there is a judgment or suit filed, you may want to speak to an attorney.

Check your credit report with the equifax trans union and experiences. Anyone can do this for free once a year, to see what is on your report. Then you can call and talk to the right people to resolve this.

Good Luck

I'd call them and find out what this is in reference to. If it's not yours, they have to prove that is it yours. People can't just garnish your wages without proof and you need papers also before this is done. I'd really find out what this is and why they think it is you.

Definitely contact them and find out what it's in regards too. May be something from awhile ago you forgot about, and it got sold to them.
