No you cannot sue an employer.

As a certified purchasing manager, I have worked for companies who paid late. Being on credit hold makes the job of inventory management and customer satisfaction (sales) more difficult. So I know how you feel.

A supplier can sue a company if they have not been paid at all.

If you are a supplier who has not been paid in a timely manner, you can refuse to sell them until they meet your payment requirement. As hard as it is for most companies to find a customer and generate a sale, most firms factor that into their pricing and delivery decisions.

I suppose that would depend on your location in the universe. In the US I think it is unlikely. An employer paying suppliers outside of terms is a very good clue that the employee should be looking for another job.
