I dont think there is a age that is stated by law, it really more so depends on the maturity and responsibility level of person who is going to babysit, personally I wouldnt allow anyone younger than 14 or 15 to babysit my son who is 5, but I would want someone a bit older to watch an infant. also it depends on the experience if they had brothers and sisters and knew how to handle any type of situation that could come up, and/or the amount time that I would be away.

I usually pay about $5 an hour, but it really depends on the person.
