my mom got ssi she's been on section 8 for years paying no rent. She had no income except my $100.00 a month. she got food stamps, and free rent. Now she has 603 a month started this month. and 7,153.00 back pay which she can't get all at once. the back pay is split up six months apart.

Anything that is deducted from her SSDI check will only be deducted from the time she filed for SSDI and was approved.

I doubt that they will take back money from the section 8 or food stamps. But if they do, it will only be from the date that she filed and was approved for SSDI.

They may take back any money that was paid to her for SSI - after she filed and was approved for SSDI.

They cannot take anything back that they had payed out to her or in her benefit from "before" the time she filed and was approved. (they may consider the date from when she qualified for SSDI payments as an overpayment period for SSI)

For an example of qualification of SSDI, I mean that if she filed on Jan. 2006, then in June 2006 SS qualified her for SSDI, they will back pay her to Jan. 2006. Any money she got from the state for SSI from Jan. 2006 on may have to be repaid. Since she would maybe still qualify for food stamps or section 8, they probably will not require that those be paid back.

For a better understanding, you might either talk to the attorney she used, if she used one, her local state caseworker or do some reading on the government SS site.

Annie may be correct that they won't touch back pay for 6 months. It would be too hard to figure out how much she would owe. SSI goes up every year. So do not even report this unless they ask. Just tell them she is receiving SSI now for $603. Most government agencies do not require you to report back pay

The other poster(not Annie) does not realize that she is on SSI and what SSI means. That is the back pay you get when SSI approves your disability.

However if they do what to take a percentage of the back check. You can apply for a hardship wavier if you need to pay loans, credit card bills and especially medical bills and/or support a disabled child.

wow need alot more information on this question.

if you are talking section 8 housing, they don't attack back pay. it is based on your monthly income, however; they can take the last 12 months of income and divide that down.

I hope they do. Those programs are for people who cant support themselves, not people who have money coming in from old jobs.
