The keyword here is, your insurance expired.... Some insurance company has grace period, some do not. You should contact them immediately.
If you sent the check on 9/7/06, chances are, it is still in transit. Even if they received it, it takes days to process it and properly credit it to your account.
I wouldn't doubt if your account now shows unpaid. (expired)
You should be covered by the at-fault party's insurance. So you are very likely fine as far as your accident is concerned.

You may or may not be covered. Common practice is for the insurance company to automatically renew the policy on the anniversary date. Some companies will give you a grace period of a few days at least (mine is 14 days) if the premium isn't paid on time. Others will refuse to renew the policy if they don't have payment by the renewal date. You'll need to check with your insurance agent.

It won't matter whether you are or not. If the other person is at fault then their insurance will pay for it. You might have a problem if that person is not insured. If that is the case then normally your insurance company would foot the bill to get your vehicle fixed. They would then take the other person to court to get the money back. If they have sent you a notice of cancellation then start looking for a new insurance company and pray that you don't have to sue the other person yourself.

Accidents are just that. Accidents. We've all been in them, hate them, and getting the estimates, dealing with the insurance co., is hell. But it happens. Go to the police station and file a report. Your insurance co. is going to ask you if you filled one out. Notify them what happened. If the guy doesn't file a claim, you're golden. If he does, his insurance co. will get his car fixed and yours will pay for the damage. He can't screw them, the independent insurance adjusters who take the pictures of the cars are usually very honest. You'll get your car fixed, he'll get his fixed and you will not have to deal with him again. If you aren't interested, just tell him your "husband" wouldn't like it. If you don't want to date him, just say so.

The post mark on the envelope and the date on the check verify your intent to pay the insurance. I would NOT call the insurance company until the check clears the bank. Otherwise they might "lose" your check.
You should not have to worry because the other person hit you.
BUT, If she didn't have insurance it will fall on your company to cover for uninsured motorist.

You may be covered it really depends on the insurance company you are with. Some will still do it. It is best to contact them regarding it that way you will know.
Otherwise you can just not make a claim.

I hope the other car is insured. Your company has the right to deny coverage after the lapse date. It is written in black and white, it is perfectly legal and they may very well return your check and cancel the policy. If you are insured with one the premium companies they will most likley will extend coverage after check has cleared and coverage has been reinstalled.
Don't ever play with this stingray again....

Since she is at fault you have no worries and a big lawsuit! People that drive drunk need to be taught a lesson, so go get her!
