They are very well taken care of by a close friend at this time. Both parents lost their job. court date is this week.Anybody been in this situation?

Unemployment is viewed as temporary. Income is not the deciding factor for custody.

The mother will probably get the children. Just because the courts think that is what is best for them. In South Carolina it is extremely hard to get your child from his/her mother even if they are on drugs and a bad parent. We went through that when my brother was trying to get his little girl. Her mother still have primary custody, but my brother has her just as much as her mom.

99.9% of the time in all situations mothers get custody of the children. In those rare instances when the father is granted custody, the mother exhibits behavior that is harmful to the children (drugs, violence, etc). courts are very relunctant to take children away from parents unless an envioronment is so unhealth that their lives are endangered.

No, but usually the mother gets custody unless there's evidence of gross negligence or abuse.
