I fail court for eye cirgury. But i went the same day to remove the Default and the lady toll me that I have to come back in two weeks. Three days after they send me a later wit the default result telling me that I have to pay what I owe to the other party. Now I'm confussed, 'cause I do not know if I still have to go? Or they dennied what I did?
Please help it is very important.

You must make an application to the court now to have the judgment vacated. The Clerk to the court should be able to let you know what forms you have to fill out. The judgment will only be reversed upon showing sufficient grounds and the costs to date may be charged to you. You must take action quickly however. If you can't afford a lawyer you can still get free advice from the community law center or you can find a lawyer who will act pro bono through the law society.

Do not worry though because if you move quickly you will be able to have the judgment suspended. The only circumstances in which judgment could be awarded without hearing is if you have not entered or do not have a defence to the action. Presumably you do have a defence or have filed a valid one.

Someone should have showed up (an attorney) to ask for a continuance due to surgery. Since no one did and they called your name 3 times and you failed to appear you defaulted your rights and with no one opposing for you the other party was awarded whatever damages and awards they were asking for. You ,sir, are SOL and up the creek without a paddle

You should have notified the court of the situation and probably would have gotten a postponement. You have vastly complicated your situation. See attorney or public defenders office. No shows are costly.

Get an attorney in your area to help you with this one. He will have to file the appropriate papers in court. You should have moved the eye surgery date.

Look up legal aid in your phone book. Most communities have a low cost lawyers to help the poor and indigent.

You have to register an appeal.
