You can only make a Citizen's Arrest on someone committing a dangerous felony. That is, they are a direct threat to others.
It also varies by State. California removed the requirement for police to respond to Citizens' arrests, probably because it revealed just how bad crime was when Citizens were making more arrests than the police.

I have a friend who held a person down physically after a road rage shooting till the police got there.
It worked, but not the smartest thing with an armed mexican!
Turns out the perp had a rap sheet a mile long.

you can make a citizen's arrest, but unless you're willing to pay a lot of money to the different lawyers who'll be all over you, don't bother. call the ins and let them do it for free.

They probably won't show up. Cops will show up first and arrest you first for holding someone against their will in your backyard. Do you know for sure he is illegal and is he bothering you? Otherwise, i would just leave it alone.

I dont see why not.Hey ,It's a free country and If you want to have your own prison you should have the right to do so.Just be sure to give him some beans to eat and a mexican flag to wave(that seems to be their form of entertainment)
