AT THE OC FAIR THIS YR MY B.F. FOUND A POUCH ON THE GROUND, AND TOSSED IT TO ME WITHOUT DISCUSSING AS HE WENT TO THE REFRESHMENT STAND. THEN SOMEONE WAS POINTING AT ME AND THEN A LADY APPEARED AND DEMANDED TO SEARCH MY PURSE. I DIDNT KNOW HER AND FELT INTIMIDATED AND WENT TO FIND MY B.F. THEN SECURITY WAS ALL AROUND AND MY B.F. GAVE HER THIS POUCE NOT EVEN KNOWING IT WAS HERS OR NOT TO GET THIS SITUATION TO END. THEN SHE CLAIMED SHE WAS MISSING MONEY. WE NEVER OPENED THE POUCH, AS THERE WAS NOT TIME, IT ALL HAPPENED IN MATTER OF MINUTES. NOW I GET A COMPLAINT WAS FILED IN THE MAIL AGAINST US FOR "LOSS OF PROPERTY-PETTYTHEFT". WE NEVER TOOK A DARN THING OR EVEN OPENED THE POUCH. A WITNESS POINTED HER AT ME TO SAY I HAD IT, WHICH SHE GOT IT BACK, BUT WE NEVER OPENED IT AND NO WITNESS CAN SAYTHAT WE DID. SO WHAT IS YOUR TAKE ON THIS? WILL IT BE MOST LIKELY DROPPED? THERE IS NO PROOF SHE EVEN HAD THE MONEY IN THERE, AND IT WAS ON THE GROUND BEFORE MY B.F. SAW IT. JUST A BIG MIX UP.

I would like to know the nature of the complaint made against you. Is it a criminal complaint (it would state a section of the penal code that was violated) or is it a small claims action? And how did they get your name and address?
The reason I ask is because criminal charges have a higher burden of proof (beyond a reasonable doubt) than civil charges (preponderance of the evidence).
So, using that matrix, if you are going to criminal court I would say you have a fair shot at getting the charges dropped , but maybe a little less chance in civil court.

There is no way for her to prove that you took the money from her purse. If the purse was dropped then the judge would look at it like she should have kept better care. Is she saying the purse was stolen from her? If then, she would still need witnesses to come forward to claim that they saw you and your boyfriend take the purse forcibly from her.
