It was for a credit line that the lawyer was supposed to pay after a seperation. Lawyer paid part of it but didn't pay all. Bank never sent anything saying that money was still owed (after 2 years). Credit has plummeted!!!

I would contact your attorney and ask him to produce the canceled check or any kind of receipt to make sure he DID payoff the balance. If he didn't, your SOL. If he did, then the bank could have made the mistake. Do your research! If the attorney didn't make the payment in full, he obviously didn't get a "payoff" before payment was made. You can do a "pay for delete". Before you payoff the bank, ask them to delete it from your credit report. See what happens. It has been done before, trust me. Get it in writing before hand.

First, you need to contact the lawyer and find out why it was not paid. If he says it was, get a copy of that receipt. If not, question why, and tell him you will contact the Bar Association in your state and report him for not doing so. Dispute it with the credit reporting agency, too. I hope you kept your paperwork from that attorney.

Right now your only recourse is to aquire another attorney. Sue the first attorney and use the money you get from the damage settlement to pay the bank.

KEEP THE BANK INFORMED ON YOUR PROCEEDINGS. if they are a good bank they will hold the account open while legal proceedings are going on.

The bank doesn't have to fix your credit until you pay the amount that is due. You should sue your lawyer for malpractice.
