Assault is the act of attempting to do physical harm to someone.
Battery is actually making physical contact.

Every state has its own definition of "assault"
Simple assault which is not a felony or punishable by prison time can be anything from throwing a soda, spitting on or tripping someone. If there was no injury or debilitating suffering by the victim then it is probably simple assault.
Aggravated assault on the other hand is when you do bodily harm with intent to do bodily harm....usually a broken bone or disabling or disfiguring injury happens , This can be a severely punishable crime if intent is proved, un addition in an aggravated assault charge if the victim is over 60 or under 12 the penalties could double or have 2 yrs added onto a jail sentence.
Was is a can or bottle of soda or like a fountain drink cause that would make a difference.

In some states it is an assault. In other states, it is harassment (offensive physical contact).
If the soda was still in the can and you threw it hard enough, it would be an assault. If things went really badly, it might be manslaughter or even murder.
My advice is to not do that.

I find it very depressing in this modern and enlightened world that this question gets asked.
Is human dignity and the right to live in peace so misunderstood?
At what point or what substance do you think it should be an assault. Soda, excrement, stone, rock, bullet?
Hit someone with anything and it is assault. The moment you think that is not the case you escalate the problem.

Any physical contact can be construed as assault. It is kind of like sexual harrassment--if she is receptive to your advances it is okay, but if she is not it is harrassment. if the person getting hit calls the cops, the first step, the cops might decline if it seems too trivial. But if pressed, the cops are obligated to make a report, though again not press the matter if it is trivial. The next step, however, is if the assaulted person obtains a lawyer to press charges, then it will not be ignored and the judge will decide if it is too trivial. Each step raises the stakes and cost.
